The Council reaches agreement in Trilogue with the Parliament on the EC proposal for a new Ship Recycling Regulation
The Council under the Irish Presidency today reached agreement in Trilogue with the Parliament on the European Commission proposal for a new Ship Recycling Regulation in first reading, said in the press release.
The compromise covers agreement on the following outstanding points:
- Requirements for recycling facilities and certification of facilities located in third countries;
- Package on the timeframe for the Inventory of Hazardous Material, the application date and the transitional period;
- Package on sanctions and exclusion from the Waste Shipment Regulation;
- Principle of equality in EU law – non discrimination clause;
- Use of the delegated act.
- Built structures for recycling
- The Commission is also required to come with a proposal 2 years after entry into force on the feasibility of any incentive mechanism.
During the process ECSA fully supported the aim of safe and environmentally sound recycling of ships and welcomed the European Commission’s proposed Regulation’s compatibility with the technical standards of the international 2009 Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships (HKC). The HKC was drafted to specifically address the intricacies of international shipping and ship recycling, and is the only instrument that can provide a serious and meaningful system of workable and enforceable regulations.

ECSA will carefully review the compromise agreement text that will now go through the formal approval process in the Parliament and the Council. ECSA is confident that this agreement between the EU Institutions is not undermining the Hong Kong Convention and urges Member States to ratify the HKC soonest allowing a quick application globally.
