Newly effective Federal Law simplifies border crossing procedure for vessels
The Federal Law On Amendments to Article 9 of the Federal Law On State Border of the Russian Federation and Certain Legislative Acts of the Russian Federation came into effect on June 18, 2013, says the Ministry of Transport of the Russian Federation.
The Federal Law is aimed to regulate multiple crossings of the State Border of the Russian Federation by commercial vessels sailing from one part of the Russian Federation to another part of Russian territory with the necessity to cross the Border of the Russian Federation due to geographic or climatic reasons.
The execution of the Federal Law requires the adoption of certain legal acts setting forth the cases subject to the Law, the procedures to be applied, the notification rules etc. The Ministry of Transport is currently engaged in the development of such regulatory legal acts.
To prevent possible conflict of law between Article 9 of the Federal Law On State Border of the Russian Federation and Article 6 of the Russian Border Crossing Act, the Federal Law No 110-FZ dated June 7, 2013 amends the fifth part of Article 6 of the Russian Border Crossing Act.
Besides, Federal Law No 110-FZ dated June 7, 2013 amends the Federal Law on the internal maritime waters, territorial sea and contiguous zone of the Russian Federation in the part regulating the stay of foreign leisure and sport sailing vessels within the internal maritime waters or territorial sea of the Russian Federation.
According to the Federal Law No 110-FZ dated June 7, 2013, foreign sport sailing vessels, having passed the border/customs controls at the checkpoint on the State Border of the Russian Federation, are allowed to sail and stay within the internal maritime waters or territorial sea outside the checkpoints on the State Border of the Russian Federation provided that it has preliminary informed the border authorities about the expected sailing district and (or) place of mooring.
According to RF Transport Ministry, the amendments are to facilitate the development of yacht tourism in Russia.
The Federal Law was passed by the State Duma on May 17, 2013, approved by the Federation Council on May 29, 2013 and signed by RF President on June 7, 2013:
