Pacifico Marine to falsify court’s judgment on recovery of RUB 110 mln for Vladivostok catamaran
On April 9, 2013, Arbitrage Court of the Primorsk Territory delivered a judgment on recovery of a 110-RUB penalty from Pacifico Marine LLC (Primorsk Territory) in favor of the state company Gosnedvizhimost (Primorsk Territory) for noncompliance with the deadline for construction of the Vladivostok catamaran which was being built for APEC summit. As IAA PortNews learnt from Vladimir Gorbanovsky, Director of Pacifico Marine, this first instance judgment will come into effect only after 2 months if not disputed at the Court of Appeal. However, Pacifico Marine will file an appeal in the nearest future.
Meanwhile, Arbitrage Court representative Inga Solodovnik interviewed by RIA Novosti said that “the Court made a decision to terminate the agreement between the parties and to recover a 110-RUB penalty from Pacifico Marine LLC in favor of the claimant for noncompliance with the deadline for delivery of the Vladivostok catamaran”.
“All in due time, - Pacifico Marine Director interviewed by IAA PortNews commented on the court proceedings and the corresponding release in the federal media. – It is the first instance. Their haste and even fussiness results in wishful thinking”.
As it was earlier reported by IAA PortNews, Pacifico Marine LLC was executing a turnkey contract for one of three passenger catamarans planned to be built for the APEC Summit-2012, and completed the hull of the second boat of the HSC series. The company operated at the territory leased from another shipbuilder - JSC Vostochnaya Verf Shipyard (Vladivostok), which, in turn, was also performing the contract for the construction of two catamarans of the same series.
The cost of each ship is about RUB 100 million.
The third catamaran, which was completed by Pacifico Marine for 7 months, could not be launched and delivered to the customer due to the illegal actions of the JSC Vostochnaya Shipyard officials, who ordered to block transportation of the completed boat to the water's edge, and also did not allow engineers of Pacifico Marine to enter the shipyard territory.
